Question 552.— A note was due February 10th, 1897. Will the Statute of Limitations protect you if action is taken February 11th, 1903, or must it be entered in Court on or before February 10th, 1903 ?
Answer.—The authorities are conflicting as to whether or not an action could have been commenced on the 10th of February, 1897. It is plain, however, that the cause of action was at all events complete on the 10th February, 1897, and that from this day the Statute of Limitations would run. As there cannot bo two elevenths of February in one year, the full six years would expire on the 10th February, therefore an action begun on the 11th February, 1903, would be too late.
