Question 17. - One of our Quebec branches sends us a cheque with pass-book attached drawn upon one of the other banks in town. The drawer of the cheque cannot write, but makes his mark and is witnessed by two clerks. The bank on which the cheque is drawn refuses payment until the mark is guaranteed by the presenting bank. This is an easy matter to do, but can the bank insist on the guarantee?
Answer. - A paying bank can insist on any requirement that it deems necessary to assure itself that it is protected in making the payment in such circumstances.
