The requisites for a contract are as follows:
I. Competent parties.11
II. An agreement between these parties reached by an offer made by one and accepted by the other.12
III. This agreement must be for a lawful purpose.13
IV. It must be based upon a consideration; 14 and
V. It must be made with all the formalities required by law.15
