In the conduct of the business, one partner may make admissions that will be binding upon the firm. Statements of a nominal partner in relation to the affairs of the firm are not admissible in evidence against the firm.12 Proof of partnership, at least prima facie proof, must be first given before admissions can be offered in evidence.
