If the person to whom a misrepresentation as to a collateral fact is made subsequently learns the truth- and with full knowledge of the facts elects not to rescind, he thereby waives his right to rescind and elects to ratify the contract.1 Such election may be made by voluntary performance with awford (Ky.), 40 S.
