In equity rights arising under a contract can be assigned, and the assignee may enforce his rights by a suit in equity in his own name.1 After assignment the assignor could not dismiss the action.2 This general rule is subject to certain exceptions and qualifications which can be discussed subsequently with greater economy of space.
