One who negligently signs a brokerage contract without reading it, relying on statements of the brokers as to its contents, is not entitled to have it set aside for fraud, when the signer had no right to rely on their statements. Kimmell v. Skelly, 130 Cal. 555, 62 P. 1067. Compare Sec. 52.
