Where, in an action by a broker for commissions for procuring a tenant for defendant, the defense was that the broker was the agent of the tenant procured, the burden of proof was on defendant to show the existence of such agency. Ballentine v. Mercer, 130 Mo. App. 605, 109 S. W. 1037.
