Question 517. - Would an assignment of book accounts hold good as against other creditors if the debtors were not notified by the bank of the assignment?
Answer. - We do not think the notification of the debtors affects the matter one way or the other, but in the absence of notice the debtor might get a good discharge from the creditor or his assignee, or the bank's claim might be postponed to that of a subsequent assignee of the book accounts who gives notice to the debtor.
Note. - In the Province of Quebec such an assignment would not avail against third parties until the debtors had been notified (C. C. Art. 1571). See also section 30 of the Bankruptcy Act.
