Question 157. - A cheque is made as follows: "Pay to A B upon the endorsation of C D." The cheque is endorsed "C D" only. Is the endorsement of A B necessary, and has the paying Bank any right to refuse payment of the cheque, it being not endorsed by A B?
Answer. - Such a form of order in a cheque would be most unusual. The endorsement of both A B and C D should be required; otherwise the drawer should be asked for instructions.
