Question 605. - What is the law governing the registration of business names such as: Jones & Jones; the Jones Company; Jones & Brothers; Jones & Company; the Jones Publishing Company?

Are there any penalties in the Province of Ontario for carrying on business under names such as any of these without registration? If there are penalties is the law enforced?

Answer. - The law regarding partnerships varies in the different provinces. In Ontario all partnerships for trading or commercial purposes (as distinguished from non-trading partnerships like a firm of accountants) must be registered except associations of individuals for the manufacture of butter or cheese and contributing produce from their dairies for that purpose, the object of registration being to inform persons who may deal with the partnership of the parties composing it. The penalty in Ontario for non-registration is $100 to each member. We have no means of knowing whether the penalties are enforced or not.
