In an action by a broker to recover his commissions, where the broker testifies that the defendant, the owner, after authorizi-ing him to sell the property at a certain price, in a later interview fixed a greater net price, it is error for the court to charge the jury that according to defendant's contention the plaintiff would not be entitled to recover unless he had found a purchaser willing to pay such larger net price.
