In an action by a principal against an agent for negligence in procuring a mortgage to be executed in her favor, in which the land was wrongly described. Held, that it should be left to the jury to say whether the plaintiff was guilty of contributory negligence is not discovering the mistake, which was patent upon the face of the mortgage. Munford v.
