In an action for a broker's commissions, an alleged abandonment of the broker's employment to sell is matter of defense which the plaintiff is not bound to negative. Moore v. Boehm, 91 N. Y. S. 125, 45 Misc. 622; Jackson v. Brower, 167 P. 6, 22 N. M. 615.
