Where a contract for the sale of real property procured by a broker was not consummated, owing to the vendor's default, that it had been orally agreed between the vendor and the broker that no commission should be paid unless the sale was consummated, was no defense to the broker's right to recover compensation. McLane v. Petty, 159 S. W. 891.
