Where, in an action for a real estate broker's commissions to be paid on securing a purchaser, plaintiff relied upon an agreement for a sale made by the owner to a prospective purchaser secured by the broker, it was not necessary for the owner to plead that the contract was not consummated by a sale, his general denial putting in issue the fact of a sale, that being necessary to entitle the broker to recover.
