Where, in an action by a broker for commissions for the sale of real estate, it was shown that defendant contracted with a third person for an exchange of property, "subject to inspection of land furnished by each party," within fifteen days, otherwise the trade should be considered closed, and that defendant refused to carry the contract into effect; the broker, in order to recover, must show a failure of defendant to inspect the land of the third person, for the right to recover would not he made out without proof that the contract between the defendant and the third person became binding by defendant's failure to inspect.
