Where the defendant enters a plea of not guilty, such plea

waives irregularities in the summons and venire.60 The circuit court commissioner is not obliged to wait one hour for the defendant to appear.61 It is proper to raise questions of title under the plea of not guilty.62 The intervention of one day between the verification of the complaint and the issuing of the summons will not invalidate the proceedings.63 The return day must be three entire days after the issuing of the summons.64 The statute provides that either party feeling himself aggrieved may appeal from the judgment of the commissioner or justice to the Circuit court upon the execution of an appeal bond in a penalty to be fixed by the officer taking the same, which must not be less than double the amount of the annual rental value of the premises.65
