Having finished the subject of the avoidance of the contract for fraud or other causes (a), it is now proposed, before considering the remedies for breach of the contract, to examine the various ways in which the obligations arising out of the contract (b) may be discharged, and the parties freed from the legal bond which unites them. This discharge may take place either before the performance and before any breach of the contract, or at the time and by the very fact of performance of the contract, or after a breach of contract has occurred (b).
