One who pays the mortgage debt under the mistaken impression that he has a valid title to or a valuable interest in the property, is entitled to subrogation to the creditor's rights,19 provided, at least, the rights and equities of others have not intervened. And a like doctrine has been applied in the case of a purchaser of the mortgaged land who, having assumed the mortgage debt, paid it under the mistaken impression that there was no other incumbrance on the property.21
