Blackstone says: Adultery is criminal conversation with another man's wife.13 According to this definition, the woman must be another man's wife; and any man, whether married or single, having illicit intercourse with her commits adultery. But neither adultery nor fornication is indictable at common law; nor is either a criminal offense in this country, unless the cohabitation is open and notorious.14
