If a lesser offense be included in the greater by the pleadings, a conviction may be had of the lesser;10 and a verdict of guilty of the lesser or lower degree is equivalent to a verdict of not guilty of the greater.11 Thus, a conviction of manslaughter on a charge of murder is an acquittal of the murder charge, manslaughter being included in murder.12
