The keeping open a place of business on Sunday and selling ice cream and meals to be eaten on the premises has been held to be a violation of a statute forbidding the keeping open any shop, restaurant or place for the reception of company, or for the sale or exposure of merchandise on Sunday.102 So the selling of newspapers on Sunday is not a work of necessity under a statute prohibiting worldly employment or business on Sunday.103
