Partnership debts after the partnership assets have been exhausted in part payment of the account may be paid out of any excess which shall remain in the hands of the executor or administrator after the payment of the individual debts of the decedent.3
(a) A claim based upon a partnership obligation will not be allowed against the estate of the decedent until it has been shown that the partnership assets are entirely exhausted. And then the allowance must be made subject to the payment of the individual creditors; the individual creditors have a right to demand, and are entitled to, a preference over partnership creditors.
