The law requires that when the jury retire to consider of their verdict, they shall be attended by a sworn officer. This requirement is mandatory; and the failure to swear the officer who attended the jury is reversable error;47 but perhaps not so in cases which are not capital.48 But if the defendant does not object to an unsworn officer attending the jury, he waives the irregularity.49
