An agent who sells property, rights or privileges at auction to the highest bidder, for a commission, is called an auctioneer.12 He is the agent for both the seller and the purchaser. He is the agent of the owner until the goods are knocked down, then he is the agent of the purchaser, for the purpose of carrying out the sale. The auction itself, consists in the sale of the goods by the auctioneer at public outcry, to the highest bidder, and according to the terms of the sale as published.
