Similar to the discharge of a contract by release, is discharge by substituted agreement. Such a discharge is called a novation, and takes place wherever a new contract is expressly substituted for the old one, or where a new contract is made which is inconsistent with the old one. Such a contract ordinarily requires no other consideration than the mutual promises of the parties.
