Even at Common Law the proper plaintiff in an action for the breach of a covenant running with the land is the holder of the title thereto at the time of breach, though he may not be the original grantee.1 When a covenant running with the land is broken, the right of action for such breach does not run with the land;2 restrictions on the use of the premises leased either against an assignee3 or a sub-lessee.4
