If such a contract is broken by the vendee, the measure of damages is the contract price less the market price.1 Thus in case of a breach of a contract to buy cattle the vendor cannot keep them for six months at the vendee's expense.2 The market price at the time and place of delivery is to be taken as a standard.3 If by the contract the property is to be delivered " during" a certain month,4 or if it is to be delivered as ordered during the year, any arrears in the total amount to be delivered on the last day,5 the market price on such last day is to be taken as the standard. If a fair public sale is made by the vendor after advertisement, the selling price is to be taken as the market price,6 even if the vendor buys the property in himself.7 Thus in case of a breach of a contract to buy a note and mortgage, the measure of damages is the amount of the deficiency left after foreclosure.8 The right to fix the price by a resale is especially clear if the property is of such sort as depreciates rapidly.9
