If a contract of sale has been performed by the vendor, and title has passed to the vendee, and the vendee refuses to pay, the measure of damages is the contract price.1 If the title has passed and there is a breach of a warranty, the measure of damages is the value that the property would have had, if it had been as warranted, and its value as it actually is.2 In
