In the absence of a contrary showing, land is sold within a parol contract authorizing a broker to sell land for another, in consideration of a stipulated commission, when the broker produces a purchaser willing and able to comply with the terms of the sale and an agreement is entered into between the purchaser and the vendor which terminates in an actual transfer of the title, or when the agent has performed the services required of him and the vendor and purchaser enter into an enforceable contract; the word "sold" not necessarily meaning that a conveyance must be made, or that the title must pass.
