Under the police power various municipal departments are empowered to prescribe rules and regulations for the character, conduct and condition of buildings. These rules are enforced in event of disregard by filing notice of violation against the property and later by fine or judgment. The notice of violation of itself is not in law an encumbrance or lien on the property, though complying with the violation is expensive and failure to remedy the defect may result in serious trouble. The violation not being a lien the seller, but for this clause in the contract, could saddle the purchaser with immediate, possibly large expenses. Hence the purchaser's insistence on this agreement.
