Partnership is the relation subsisting between two or more persons who have contracted together to share, as common owners, the profits of a business carried on by all, or any of them, on behalf of all of them.10 Partnership is in one sense a form of agency, as each partner represents, and has power to act for, each of the other. Partnership is one of the most specialized and difficult branches of contracts, it is the twenty-third subject treated in this work, and will be found in Volume VIII.
