As a general rule, equity will not enforce specific performance of an oral contract, which, under the statute of frauds should have been in writing.14 There are, however, a number of exceptions to this rule. Part performance will take a case out of the operation of the statute,15 and the statute of frauds will never be allowed to be invoked as a cover for fraud.16
