The statute in some states varies from the English statute. In Illinois, for instance, it applies to any contract for the sale of lands, etc., or any interest in or concerning them, "for a longer term than one year."77 And in other states it applies only to contracts for the sale of lands or for the lease thereof for a longer term than one year?78
43. The following rules may be mentioned:
(a) The agreement must be impossible of performance within the year.
(b) In some jurisdictions the agreement must contemplate nonperformance by both parties within the year.
(c) In a few jurisdictions this clause of the statute does not apply to agreements relating to land.
