It has already been seen 64 that assent to a contract may be inferred from the acceptance of a document which states that something is to be done by the person who accepts the document. On no principle can this doctrine be properly extended so as to make the acceptor of an instrument under seal, a convenantor. He has not sealed and delivered the instrument as his obligation.65

An exceptional doctrine, however, has widely prevailed to the effect that the acceptance of a deed implies a covenant on the part of the acceptor to do whatever is stated in the deed to be done by him; especially where the deed conveys an estate and the acceptor takes possession of the estate.65a
