Statements which purport in part to be matters of opinion may involve statements of fact, and in such a case they are treated as misrepresentations.1 An estimate which is said to be approximate only may be so grossly inaccurate as to be a misrepresentation.2 A provision that the contractor most take the risk of errors in specifications does not apply to absolute misstatements of fact3 A statement as to the area of a specific tract of land and as to the number of fruit trees that could be planted thereon, may be a misrepresentation.4

An innocent misstatement as to the kind of building which the vendee intends to construct upon the realty purchased by him,5 or as to the condition of one who has been injured,6 or as to the amount of work remaining to be done,7 is a misrepresentation of fact. A statement that the coal underlying certain land contains so small an amount of sulphur as to be suitable for the manufacture of coke, and that it compares well with certain named coals which are standard coking coals, is a statement of fact and not of opinion.8 A statement that mineral land which is sold is an unbroken tract which embraces no land owned by other persons so as to interfere with the operation of such mines, is a statement of fact and not of opinion.9 One who is induced to buy a farm by innocent misrepresentations that it is free from stones and certain kinds of weeds and that it contains a certain number of fruit trees may have rescission if such representations are materially false.10 Where A,

583 Misrepresentation in the Inducement Sec. 365 while disclaiming any personal knowledge of a material fact, refers to B for information, and B's statements are incorrect, A is in legal effect as liable for such misrepresentation as if he had made it himself.11
